There are three elements to the negligent exercise of retained control exception to the rule immunizing the hirer of an independent contractor from liability to the independent contractor's employee:
- the hirer retains control over any part of the work;
- the hirer negligently exercises that control; and
- the hirer does so in a manner that affirmatively contributes to the employee's injury.
